Current legislative framework

The Queensland early childhood education and care sector is governed by the Education and Care Services National Law 2010 and the Education and Care Services National Regulations 2011. A small number of services continue to be regulated under the Child Care Act 2002.

The approved provider of a centre-based or home-based service must ensure that their staff hold a positive prescribed notice (Blue Card) issued by the Commission for Children, Young People and Child Guardian External Link in order to work with children and meet certain qualification requirements for their position.

A policy has been established by the Queensland Government requiring services to employ a 4 year trained (or equivalent) early childhood teacher if they wish to deliver an approved kindergarten program and access funding via the Queensland Kindergarten Funding Scheme.
