The Education and Care Services Act 2013 (ECS Act) supports quality outcomes for children and adopts elements of the National Law for some small scale services, especially those in rural and remote areas.
It applies to the following services not captured under the National Quality Framework:
Services must meet the following requirements:
Educator to child ratios are calculated across the service, based on the number of children under one Queensland approval, not by individual rooms. Read more about educator-to-child ratios
Educators needed to meet ratio requirements must hold or be actively working towards an approved qualification.

Approved services under the ECS Act must ensure a program based on an approved learning framework is delivered to children at the service.
New services and services carrying out assessable building works to their premises must adhere to the Building Code of Australia. Find out more about building and physical environment standards.
