

The closing date (24 February 2012) for the completion of transition packs sent to approved providers in late 2011 has now passed.
Approved providers who have yet to complete a transition pack for each of their services should refer to the information below to ensure they are aware of the requirements regarding nominated supervisors, certified supervisors, waivers and the use of the 1:5 educator to child ratio, if applicable.
The transition form enabled approved providers to provide the name of their nominated supervisor. The Department needs some further personal details (i.e. after hours contact number) and will be in contact with nominated supervisors to complete the required records.
If an approved provider has not identified the nominated supervisor for each of their services through the transition form, or if the nominated supervisor changes, please complete a NS02 Notification of Change to Nominated Supervisor form
and a NS01 Nominated Supervisor Consent form
and send to the Department.
In completing the transition form, approved providers provided the names of persons identified as declared certified supervisors for each of their services. The Regulatory Authority (Department of Education and Training) will write to these educators in the next few weeks, via the service where they were identified, to obtain their personal details before distributing supervisor certificates by 30 June 2012.
A form to request a supervisor certificate will be available for any educators who are declared certified supervisors but were not included on the transition forms or have moved services since the transition form was completed. Find more information on certified supervisors here.
Many services indicated on the transition form, that they meet the eligibility requirements and can justify a need to continue using a 1:5 ratio for children aged from 15 to 24 months. These services have received a confirmation email to indicate that the Department has received their application. The Department will verify if the service meets the eligibility requirements and, if approved, a condition will appear on their service approval as follows:
This service is approved to use a 1:5 ratio for children aged from 15 to 24 months. This condition expires on 31 December 2017.
Services that have not applied via the transition form and want to continue using the 1:5 ratio for this age group must complete and submit the application form

Services with a permanent exemption under the Child Care Act 2002 (as listed in Schedule 2 of the Child Care Regulation 2003), must submit an application for a waiver if they are unable to meet the physical environment requirements in the National Regulations. Applications must be received by 31 March 2012 as per section 310 of the National Law.
The Department has contacted services which may be affected by this requirement. There is no fee for the application of a waiver for these services.
Services with approval to exceed their capacity for up to two hours per day under the Child Care Act 2002 who wish to continue this practice under the National Law may also need to submit an application for waiver. The waiver will only be required if the service does not meet the physical environment requirements in the National Regulations.
The Department has contacted services that may be affected by this requirement. There is no fee for the application of a waiver for these services and applications are required by 30 April 2012. This timeframe will ensure that waiver applications are decided prior to assessment and rating visits.
Approved providers who wish to merge service approvals for services on the same or adjoining land lots must apply to the Department for an amendment, unless the services have already been identified for automatic merging.
In requesting that a service approval cover co-located or adjoining premises providing different service types (e.g. kindergarten and school age care), the approved provider should give consideration to the potential implications in relation to regulatory requirements including:
Services should also consider the implications for the assessment and rating process, including the development of the Quality Improvement Plan.
The Department will issue services with new Provider and Service Approvals and supervisor certificates by 30 June 2012.
If the Department requires further information or clarification, departmental staff will contact the approved providers before issuing the provider and/or service approval.
